These Terms and Conditions apply to the website and premises of O’Sullivan’s Irish Sports Pub, located at 5660 Thornton Ave., Newark, California 94560.
By visiting our website, entering or remaining on the premises, attending an event, opening a tab, or purchasing our products or services, you agree to these Terms and Conditions and all posted house rules.
O’Sullivan’s is a 21-and-over establishment.
Every guest must present a valid U.S. government-issued photo identification card or valid passport upon request.
We may refuse entry or service when identification is missing, expired, altered, damaged, unverifiable, or does not reasonably match the person presenting it.
Only compliant patrons, employees, authorized vendors, delivery personnel, contractors, invited guests, and other persons conducting legitimate business may enter or remain on the premises.
Management reserves the right to refuse entry, refuse service, discontinue alcohol service, or require any person to leave for lawful reasons, including:
These policies will be enforced without unlawful discrimination and in accordance with applicable law.
Weapons are prohibited on the premises to the fullest extent permitted by law.
Prohibited weapons include firearms, knives intended or used as weapons, clubs, impact weapons, chemical weapons, explosives, and any other item carried, displayed, threatened, or used as a weapon.
Authorized on-duty law-enforcement personnel acting within the scope of their official duties are exempt. Management may recognize other exemptions when required by law.
Possession, display, or suspected possession of a prohibited weapon may result in denied entry, immediate removal, banning, trespass enforcement, and notification of law enforcement.
Employees and guests should not attempt to disarm another person. Any immediate threat involving a weapon should be reported to 911.
As a condition of entry or continued presence, any person may be asked to consent to reasonable security screening of their person and accessible belongings, including purses, backpacks, packages, and other bags.
Screening may be requested by security personnel or management when considered appropriate for:
O’Sullivan’s will not forcibly search a person. However, anyone who refuses a requested security screening may be denied entry or required to leave.
Security personnel or management may prohibit bags or particular items from entering the premises. A guest may be required to return a purse, backpack, package, or other bag to their vehicle before being admitted.
O’Sullivan’s does not accept responsibility for property left in a vehicle.
Security screening and bag policies will be administered lawfully, consistently, and without unlawful discrimination.
O’Sullivan’s maintains a strict no-drug and no-gang-activity policy.
The possession, use, sale, distribution, solicitation, or trafficking of illegal drugs is prohibited. Credible indications of illegal drug activity may result in security intervention or notification of law enforcement.

Violations may result in refusal of entry, removal, banning, trespass enforcement, and notification of law enforcement.
This policy is based on conduct, identifiable prohibited displays, credible safety information, and documented security concerns. It will not be enforced solely because of a person’s race, ethnicity, national origin, neighborhood, hairstyle, or other legally protected characteristic.
For the safety of guests and employees, clothing, accessories, tattoos, or other displays that clearly identify or promote a criminal street gang, outlaw motorcycle gang, or organization reasonably associated with violence or unlawful activity are prohibited.
Prohibited displays may include:
Management or security may require prohibited tattoos or displays to be covered while the person remains on the premises.
Management or the Head of Security may maintain and periodically review a list of specifically identified prohibited insignia based on credible security information, documented incidents, law-enforcement information, or legitimate operational experience.
Security personnel or management may ask a person to remove, cover, or return prohibited clothing or accessories to their vehicle. Refusal may result in denied entry or removal.
When affiliation or prohibited attire is uncertain, the decision will be referred to management or the Head of Security. Employees should not make unsupported accusations concerning a person’s membership in any organization.
Because of documented local safety concerns and prior incidents involving color-associated conflicts, O’Sullivan’s maintains a limited and content-neutral safety dress standard.
Plain, solid-red or solid-blue T-shirts without printed graphics, lettering, logos, or other clearly distinguishing designs are not permitted on the premises.
This rule applies equally to every guest, without regard to race, ethnicity, national origin, neighborhood, actual or perceived affiliation, or any other protected characteristic.
A person wearing a prohibited shirt will ordinarily be given the opportunity to:
Reentry remains subject to the usual identification, capacity, intoxication, security, and house-rule requirements.
Wearing a prohibited shirt does not, by itself, establish gang membership, justify an accusation of gang affiliation, or automatically result in a ban. A person who respectfully complies may request reentry without penalty.
Refusal to comply with the dress standard may result in denied entry or a request to leave. Threatening, abusive, intimidating, or disruptive conduct during enforcement will be addressed separately under O’Sullivan’s conduct, removal, and banning policies.
Reasonable modifications will be considered when required by law, including for disability, medical, or sincerely held religious reasons. Questions and unusual circumstances must be referred to management or the Head of Security.
O’Sullivan’s may implement additional temporary dress or security requirements for major events or documented safety concerns, provided those requirements are communicated and enforced consistently and lawfully.
No patron, vendor, representative, contractor, delivery person, or other visitor may harass, threaten, intimidate, discriminate against, verbally abuse, physically abuse, sexually harass, stalk, bully, or otherwise mistreat an employee or guest.
The following conduct is prohibited:
Violators may be denied service, removed, banned, reported for trespassing, or referred to law enforcement.
Vendors or representatives who abuse or mistreat employees will be referred to management and may lose permission to conduct business with or enter O’Sullivan’s.
Guests must comply with reasonable instructions from employees, management, and security personnel.
When a person is asked to leave, they must promptly gather their belongings, close their tab when possible, and exit without threatening, harassing, or interfering with employees or guests.
Refusal to leave after permission to remain has been withdrawn may result in law-enforcement contact and trespass enforcement.
Removal for violating these Terms or other house rules does not entitle the person to a refund.
Unless a different period is stated by management or the Head of Security, a ban from the premises remains in effect for a minimum of six months.
A banned person may not enter, remain on, or return to the premises during the ban period without express authorization from management or the Head of Security.
O’Sullivan’s may extend a ban when:
Conduct involving gangs, drugs, weapons, assault, threats, sexual misconduct, stalking, or repeated violations may result in an extended or indefinite ban.
Expiration of the initial six-month period does not guarantee readmission. Management and the Head of Security retain discretion to determine whether and under what lawful conditions a previously banned person may return.
Entering or refusing to leave while banned may result in law-enforcement contact and trespass enforcement.
O’Sullivan’s is a private business and does not serve as a court, process server, or personal enforcement agency for disputes between individuals.
However, O’Sullivan’s will comply with applicable law, valid court orders, and lawful instructions from law enforcement.
A person requesting assistance concerning a restraining order should:
O’Sullivan’s employees and private security personnel do not determine the legal validity, scope, or meaning of complicated court orders. Law enforcement may be contacted for assistance.
When individuals involved in a dispute or restraining-order matter are present at the same time, security personnel and management may take reasonable steps to maintain peace and protect guests and employees.
When no law or court order requires a different result, management may consider:
Guest and employee safety takes priority over any patron’s preference to remain.
Security personnel or management may require one party, multiple parties, or all involved parties to leave. Depending on the circumstances, one or more parties may also be banned or reported for trespassing.
Nothing in this section limits the authority of law enforcement or changes any person’s obligations under a valid restraining order.
Alcohol will be served only to guests who are at least 21 years old and present valid identification.
O’Sullivan’s may refuse or discontinue alcohol service when:
Guests may not bring outside alcoholic beverages onto the premises unless specifically authorized by management and permitted by law.
Guests are responsible for closing their tabs before leaving.
Any card or tab left open at the end of the business day may be closed using the payment card on file.
A 20% gratuity will be added to all cards and tabs left behind or left open at closing, together with applicable taxes and other authorized charges.
This policy is disclosed in advance and forms part of the guest’s agreement when opening a tab. Billing concerns should be reported promptly to management.
Persons wishing to meet with management, solicit business, present products or services, discuss accounts, or conduct other nonurgent business may be asked to return during regular management office hours:

Vendors or representatives who abuse employees or violate these rules will be referred to management and may lose permission to enter the premises or conduct business with O’Sullivan’s.
Food, beverage, and related commercial deliveries must be made through the designated kitchen delivery door unless management directs otherwise.
Delivery personnel must announce themselves and clearly identify the company they represent before entering or unloading products.
Delivery personnel may not:
Mail, parcels, and ordinary package deliveries must be directed to the bartender on duty or another authorized employee during reasonable business hours.
Delivery personnel may not leave packages unattended without employee acknowledgment or enter employee-only areas without permission.
O’Sullivan’s may refuse packages that are:
Guests are responsible for their belongings.
To the fullest extent permitted by law, O’Sullivan’s is not responsible for lost, misplaced, unattended, damaged, or stolen property, including phones, wallets, purses, clothing, payment cards, or other personal items.
Found property may be retained temporarily, but recovery is not guaranteed. Guests should contact the pub promptly concerning missing property.
O’Sullivan’s may require reasonable proof of ownership before releasing found property.
Parking is at the vehicle owner’s risk.
O’Sullivan’s does not provide guarded parking and, to the fullest extent permitted by law, is not responsible for:

Vehicle owners remain responsible for complying with posted parking restrictions and applicable laws.
As required by our licensing conditions, security personnel are scheduled on Friday and Saturday nights.
Additional security may be provided for major events, holidays, or other occasions when management determines it is appropriate.

Event schedules, entertainment, menu items, prices, promotions, performers, and operating hours may change without notice.
Reservations, ticket purchases, deposits, cover charges, and event packages may be subject to additional terms disclosed when booked or purchased.
Admission remains subject to age, identification, capacity, intoxication, security, attire, and conduct requirements, even when a person has purchased a ticket or made a reservation.
Removal or denial of entry for violating these Terms or other disclosed house rules does not entitle the person to a refund, except when otherwise required by law.
Website information is provided for general informational purposes. Although we attempt to keep information accurate, availability, prices, menus, schedules, promotions, and operating details may change.
O’Sullivan’s names, branding, logos, graphics, photographs, and original website content may not be copied, reproduced, modified, distributed, or used for commercial purposes without written permission.

O’Sullivan’s may revise these Terms and Conditions periodically.
Updated terms become effective when posted with a revised effective date. Continued use of the website or premises after an update constitutes acceptance of the revised terms.
If any portion of these Terms is found invalid, unlawful, or unenforceable, that portion will be interpreted or limited to the minimum extent necessary, and the remaining portions will continue in effect.
A delay or failure by O’Sullivan’s to enforce a particular rule or provision does not waive its right to enforce that rule or provision later.
An exception made on one occasion does not create a right to the same exception on another occasion, except when otherwise required by law.
These Terms are governed by the laws of the State of California.
Any dispute relating to these Terms will be handled in a court of proper jurisdiction in Alameda County, California, unless applicable law requires otherwise.
